DISTRIBUTION AGREEMENT

TERMINOLOGY

Copyright holder:  Refers to the individual, group or company that holds the rights to the music or the individual, group or company that has been given permission by the copyright holder to submit the music.

This is an agreement between Metacomet Music Distributors, LLC (the distributor) and the copyright holder in regard to the distribution of music to various Internet and brick & mortar retail stores, the collection of revenue and the payment of royalties to the copyright holder.

ROYALTY PAYMENTS

The distributor agrees to pay royalties to the copyright holder from the revenue collected directly by the distributor.  The royalties must reach a minimum of $50.00 in order for a payment to be made.

DIGITAL DISTRIBUTION

The distributor agrees to distribute the digital album through its partner Catapult Digital Music Distribution.  Catapult keeps, for their fee, 9% of what they collect from the retailers.

PHYSICAL DISTRIBUTION

The distributor agrees to distribute, either directly or through a partner distributor, the physical album to Internet and brick & mortar retailers.  If the album is distributed through a partner distributor then the partner distributor, for its fee, may keep a percentage or set dollar amount.

DISTRIBUTION TO AMAZON

The distributor agrees to sell the physical album directly on Amazon.  Amazon keeps, for their fee, 55% of the retail price of the album.

PANDORA INTERNET RADIO

The distributor agrees to submit the physical album to Pandora Internet Radio.  Pandora does not guarantee that it will accept the album.

COSTS

Both parties will agree that 100% of the net revenue collected by the distributor will first be used to recoup costs incurred by the distributor before the agreed upon royalties will be paid out to the copyright holder.

REIMBURSEMENT COSTS

All prices quoted are the costs that are incurred by us and will be recouped by us with the revenue collected from the selling of your album.  You do not have to pay us these costs up front, they will be deducted from your royalties. Once the costs are paid in full, your royalties will be paid out to you.

CATALOG MAILING COSTS

If your album is the only one being mailed then costs are charged on a per album, per group, per mailing basis.  If your album is among others then your cost will be a percentage of the entire cost of the mailing which will be determined at that time.

If yours is the only album being mailed then the catalog mailing costs are as follows. If more than 5 albums please contact us for a quote.

PHYSICAL AND DIGITAL DISTRIBUTION COSTS

The upfront digital distribution cost for a single song is $9.00 and an entire album is $25.00.  The upfront CD Baby selling cost is $35.00.  There is no upfront selling cost for distributing the physical album to Amazon.com, brick and mortar or internet retailers.

If the album does not already have a UPC barcode one will be assigned for a cost of $20.00.

FEE

The fee for the distribution service that Metacomet Music Distributors, LLC provides is 5% of the net revenue collected from partners and retailers.

All costs and fees quoted can change at any time without notice.  This distribution agreement can change at anytime without notice.
